President of hair testing company sentenced for defrauding 88,000 customers out of $5.9 million

NEW YORK — Kyle Tsui, the former president of a company that sold fraudulent allergy and sensitivity tests, was sentenced to 41 months in prison for orchestrating a scam that defrauded more than 88,000 customers out of $5.9 million, according to U.S. Attorney Damian Williams. The sentencing, handed down by U.S. District Judge Kenneth M. Karas, followed Tsui’s guilty plea to wire fraud and mail fraud charges.

Tsui, 41, was extradited from Spain in November 2023 to face charges related to the scheme, which ran from September 2018 to April 2019. Tsui’s company falsely advertised its “highly-rated” testing services, which claimed to analyze hair samples to determine sensitivities to 800 different food and environmental items.

In reality, Tsui directed his employees to discard the samples without any laboratory analysis, and customers were given fabricated results.

Tsui paid more than $4.1 million in forfeiture ahead of his sentencing, which will be used to compensate the victims of the scam. In addition to his prison sentence, Tsui was ordered to serve one year of supervised release.

“Tsui defrauded tens of thousands of innocent victims, whose health was put at risk with false allergy and sensitivity testing results,” said U.S. Attorney Williams. “Today’s sentence—and the recovery of all the money Tsui stole—sends a message that brazen schemes like Tsui’s do not pay.”

The investigation was assisted by multiple law enforcement agencies, including the U.S. Postal Inspection Service and international authorities.
