Queens man hit with 16 count indictment in alleged stairwell rape horror

White Plains, NY – A Queens man accused of trapping and sexually assaulting a woman for hours inside a downtown parking garage stairwell has now been indicted on 16 felony counts in a case prosecutors described as exceptionally brutal.

Xavier Fonseca Overton, 22, of Astoria, was arraigned Tuesday in Westchester County on charges connected to the alleged attack inside the White Plains City Center stairwell last month, according to the Westchester County District Attorney’s Office.

Prosecutors allege Overton repeatedly raped the victim over the course of several hours while she was unable to defend herself or consent.

Officials did not publicly detail the full list of charges contained in the indictment but described them as multiple serious felonies related to sexual assault.

Overton pleaded not guilty and is scheduled to return to court on June 9.

Westchester County District Attorney Susan Cacace said the indictment reflects what prosecutors described as the severity and cruelty of the alleged conduct.

Authorities also credited White Plains Public Safety and Commissioner Wade Hardy for the investigation leading to the arrest and indictment.

The defendant remains presumed innocent unless proven guilty in court.
