New Jersey Congresswoman Who Fought ICE Agents Vows to Continue Fighting

New Jersey congresswoman files appeal as legal battle over Newark incident continues

Newark, NJ – U.S. Rep. LaMonica McIver is escalating her legal fight against federal charges stemming from a confrontation outside an immigration detention facility, filing a brief in the Third Circuit Court of Appeals seeking to have the case dismissed.

The charges stem from a May 9, 2025 incident at the Delaney Hall ICE detention facility in Newark, where McIver and other officials were present during what she described as a congressional oversight visit. The situation escalated as federal agents attempted to arrest Newark Mayor Ras Baraka, leading to a physical confrontation.

Update: McIver continues to maintain her innocence saying the charges are political.

Federal prosecutors allege McIver interfered with law enforcement during the arrest, accusing her of striking and obstructing officers. She has pleaded not guilty to multiple counts of assaulting, resisting, and impeding federal officers.

Key Points

  • Rep. LaMonica McIver filed a Third Circuit brief seeking dismissal of federal charges
  • Case stems from a 2025 confrontation outside Newark ICE detention facility
  • Prosecutors allege she interfered with officers; McIver says she was performing oversight

In a public statement accompanying the filing, McIver pushed back against the allegations and criticized federal agencies involved in the case.

“As the brief clearly lays out and as I have demonstrated from the beginning, I went to Delaney Hall to do my job,” McIver said. “ICE interfered with that work, and then DHS lied about why I was there.”

She further added, “They have continued to lie about this case at every turn, but their lies will not deter me—I will keep fighting to expose how this administration is hurting people. I am not backing down.”

Legal fight centers on limits of congressional oversight

The case has drawn attention due to its legal and constitutional implications, particularly regarding the scope of congressional oversight authority. McIver’s defense has argued that her actions were part of her official duties, though a federal judge previously ruled that physical interference with an arrest is not protected under the Constitution’s Speech or Debate Clause.

McIver also framed the case as an attempt to deter political opposition. “The people of New Jersey are entitled to vigorous representation. Donald Trump will not take that away,” she said.

The case remains active, with appellate proceedings now underway as McIver seeks to have the charges dismissed before trial.
