Pennsylvania Woman Sues Point Pleasant Beach, Jenkinson’s Boardwalk Over Fall Near Shore Attraction

A Pennsylvania woman claims a hazardous sidewalk condition near Jenkinson’s Boardwalk caused a fall that left her with severe and permanent injuries, according to a lawsuit filed in Ocean County.

A visitor from Pennsylvania has filed a personal injury lawsuit against the Borough of Point Pleasant Beach, the Point Pleasant Beach Department of Public Works, and Jenkinson’s Boardwalk, alleging negligent maintenance of a sidewalk caused a serious fall.

The lawsuit was filed by Carol McCoy of Hollidaysburg, Pennsylvania, and her husband, Arthur McCoy. According to court filings, the incident allegedly occurred on or about Aug. 5, 2025, at property located near 300 Ocean Avenue in Point Pleasant Beach.

Lawsuit alleges hazardous sidewalk condition

According to the complaint, McCoy was lawfully on the premises when she encountered what the lawsuit describes as a hazardous condition on a sidewalk. The filing alleges the area was negligently maintained, allowing a dangerous condition to exist that caused her to fall.

The lawsuit names three primary defendants — Point Pleasant Beach, the borough’s Department of Public Works, and Jenkinson’s Boardwalk — claiming each had responsibility for maintaining or supervising the area where the incident occurred.

The complaint alleges the defendants “carelessly, negligently and recklessly maintained, controlled and supervised said premises so as to allow a hazardous condition to occur on the sidewalk.”

Plaintiff claims lasting injuries

McCoy alleges the fall resulted in severe and permanent injuries that required medical treatment and caused significant pain and suffering. The complaint further claims the injuries affected her ability to carry out normal daily activities and business affairs.

According to the lawsuit, she was “forced to seek medical aid and attention” and was “otherwise severely and permanently damaged.”

Her husband also joined the lawsuit, claiming loss of consortium and alleging he incurred expenses related to her medical care and treatment.

Jury trial requested

The lawsuit seeks damages, interest, and legal costs from the defendants. Court records show the plaintiffs have requested a jury trial.
