West Virginia Man Admits to Illegal Firearm Possession

ELKINS, WEST VIRGINIA — James Matthew Miller, a 49-year-old resident of Camden, West Virginia, has pleaded guilty to unlawfully possessing firearms. This admission comes while he was under federal supervised release from a previous wire fraud conviction in the Northern District of West Virginia.

Court documents detail that during a routine check by United States Probation Officers, a .22 caliber pistol and a rifle were discovered at Miller’s residence. Given his criminal history, Miller is legally prohibited from possessing any firearms.

The offense carries a potential sentence of up to 15 years in federal prison. The final sentencing will be determined by a federal district court judge who will consider the U.S. Sentencing Guidelines among other statutory factors in deciding the appropriate penalty.

The case is being prosecuted by Assistant U.S. Attorney Stephen Warner and was investigated by the Bureau of Alcohol, Tobacco, Firearms, and Explosives in conjunction with the U.S. Probation Office.
