BRONX, N.Y. — A New York Police Department officer has been charged in two separate indictments involving an alleged cover-up of a patrol car accident and an assault during an arrest, Bronx District Attorney Darcel Clark announced Thursday.
Officer Kenny Victoria, 34, who was assigned to the 44th Precinct, faces charges for falsifying a police report after a patrol car struck a motorcyclist last year and for allegedly assaulting a suspect with a police radio during an arrest in April. He was arraigned in Bronx Supreme Court before Justice Brenda Rivera and is scheduled to appear again on December 3.
In the first indictment, Victoria was charged with attempted offering a false instrument, falsifying business records, and official misconduct. According to the investigation, on December 16, 2023, Victoria allegedly filed a false collision report after a police car he was in struck a motorcyclist near Monroe Avenue and East 173rd Street. Video surveillance reportedly contradicted Victoria’s account, showing the police vehicle accelerating into the motorcyclist, who sustained a leg fracture.
In a second incident, Victoria was charged with second- and third-degree assault, as well as official misconduct. Prosecutors allege that on April 30, 2024, Victoria struck a suspect on the head with his police radio after the man had been subdued by another officer. The suspect required staples for a head injury.
District Attorney Clark said in a statement, “His alleged actions are a betrayal of public trust and tarnish the shield.”
