ICE arrests Salvadoran alien in Virginia after illegal reentry following sexual assault conviction

FAIRFAX COUNTY, Va. — U.S. Immigration and Customs Enforcement (ICE) officers arrested Nicolas Alberto Hernandez-Lopez, a 46-year-old Salvadoran national, on Jan. 15 in Fairfax County, Va., after he unlawfully re-entered the United States following his removal in 2023.

Hernandez-Lopez was convicted of second-degree sexual assault in Fairfax County on March 7, 2019, and sentenced to prison. ICE first arrested him on April 7, 2023, and a Department of Justice immigration judge ordered his removal on May 23, 2023. ICE officers deported him to El Salvador on June 9, 2023.

Authorities determined that Hernandez-Lopez unlawfully re-entered the U.S. at an unknown date and location without inspection, admission, or parole by an immigration official.

“Nicolas Alberto Hernandez-Lopez illegally reentered the United States, and then victimized a resident of our Virginia community,” said ICE Enforcement and Removal Operations Washington, D.C. acting Field Office Director Patrick Divver. “This is not something that the officers of ICE Washington, D.C. will tolerate.”

Hernandez-Lopez remains in ICE custody as officials continue removal proceedings.
