New York City, NY– As of today, new rules governing the take-off and landing of unmanned aircraft, including drones, are in effect in New York City. In collaboration with the New York City Department of Transportation (DOT), the New York City Police Department (NYPD) has initiated the process of accepting applications for Unmanned Aircraft (UA) Take-off/Landing permits. These permits aim to strike a balance between safety and privacy concerns associated with the widespread use of drones and the valuable benefits that this modern technology offers.

Under the new rules, individuals operating drones within the five boroughs of New York City are required to obtain a UA Take-off/Landing permit from the NYPD. The permitting process takes into account federal, state, and local laws while ensuring the responsible use of drones.

Previously, drone take-offs and landings were limited to locations designated by the DOT and model aircraft fields designated by the Department of Parks and Recreation. However, in June 2023, the City of New York proposed changes to The Rules of the City of New York (38 RCNY Ch. 24) that allow the public to request temporary designations for other drone take-off or landing locations within the City. The proposal was made available for public comment, and a public comment hearing was held on July 7, 2023, at 1 Police Plaza.

To apply for a UA Take-off/Landing permit, operators must submit their applications through the NYPD Online Services Portal website: http://www.nyc.gov/dronepermits. Each application must include proof that the proposed operator holds a valid license to fly unmanned aircraft issued by the Federal Aviation Administration (FAA). In most cases, applications must be submitted at least 30 days in advance of the intended take-off or landing date. Approved applicants will receive their permits electronically, forty-eight (48) hours before the scheduled flight.

While operating drones in New York City with a permit, operators must carry and present the necessary documentation upon request by law enforcement, including:

The City-issued UA Take-Off/Landing permit
A copy of their insurance policy
Documentation of FAA authorization to operate a drone
A copy of the FAA registration certificate for the drone(s) being flown

Operators must adhere to all FAA, city, state, and federal regulations during their flights.

The City of New York reserves the right to alter, postpone, or cancel flights when necessary. Operators will be promptly notified of any changes in flight status. It is the responsibility of operators to check the status of their permits before conducting flights within the city.

Operating a drone without a permit, engaging in reckless or dangerous drone operations, or using a drone to commit a crime may result in a summons or arrest for the operator, with the possibility of drone seizure. Members of the public witnessing harassing, reckless, or injury-causing drone operations are encouraged to call 911.

Applicants who have had their applications denied can file an appeal application following the instructions available on the NYPD Online Services Portal.
