CUMBERLAND, Md. — The Cumberland Police Department made three arrests between Friday and Sunday in unrelated incidents involving assault, impaired driving, and failure to appear in court, according to an official press release issued Sunday.
On Friday evening at approximately 6 p.m., officers responded to the 600 block of Columbia Avenue for a reported assault. Upon arrival, they spoke with a victim who stated they were slapped in the face by 24-year-old Brian James Fussell of Cumberland. Officers observed slight redness on the victim’s face and, following an investigation, placed Fussell under arrest. He was taken to Central Booking and remanded to the Allegany Detention Center without bond after a bail review with a District Court commissioner. Fussell is charged with second-degree assault.
In a separate incident early Saturday morning, officers were dispatched around 3:20 a.m. to the 400 block of Virginia Avenue following a report of an impaired driver. Police made contact with Matthew Lynn Hutzel, 38, of Wiley Ford, W.Va., who showed signs of intoxication, including a strong odor of alcohol. Hutzel was arrested and transported to police headquarters, where he was issued multiple citations and later released pending a court date.
Hutzel faces several charges: driving under the influence of alcohol, driving under the influence per se, driving while impaired by alcohol, and operating off-road vehicle equipment on a public highway.
Warrant served for failure to appear
On Sunday, officers served a bench warrant on 44-year-old Gary Wayne Ray of Cumberland, stemming from his failure to appear in court on June 16 for an original charge of controlled dangerous substance (CDS) possession not marijuana. Ray was arrested and taken to Central Booking. He was later released after appearing before a District Court commissioner.
All three individuals await future appearances at District Court as proceedings continue.
