The family of Ashli Babbit, the 35-year-old woman shot and killed while unarmed during the U.S. Capitol incursion is now planning to sue the Capitol Police Department in a wrongful death lawsuit.
Babbit was shot dead by Capitol police as she was climbing through a window to access a hallway where armed officers waited with guns drawn. Her murder was caught on video. The U.S. Justice Department found no probably cause to charge the officer who fired the ready shot that killed the young Air Force veteran.
“In the eyes of her family? Of course she was,” attorney Terry Roberts told CBS. “I mean, there was just no legal justification to take her life. She could have easily been stopped by the officer who shot her or numerous other officers who were around and been arrested, if that’s what they wanted to do. There was no need to shoot her.”
In the video captured of her death, bystanders warned, “He’s got a gun, get down, this is going to get ugly.”
Seconds later Babbit was shot dead as she attempted to climb the window.
