Jackson Township Settles Lawsuit with Agudath Israel of America

JACKSON, NJ – After seven years of legal challenges, Agudath Israel of America has finalized a settlement with Jackson Township Council, ending a dispute over zoning laws that restricted religious land use.

In 2017, Agudath Israel initiated litigation against the Council, alleging that new zoning regulations were intentionally obstructive to the building of schools, dormitories, and eruvs by Orthodox Jews, in violation of the Religious Land Use and Institutionalized Persons Act (RLUIPA).

The settlement introduces a new era for the township’s Orthodox community, which includes many families commuting daily to nearby Lakewood for education. The agreement permits the construction of religious schools and dormitories in a manner that aligns with the suburban environment of Jackson. In addition, it compels the Council to adopt ordinances allowing the establishment of houses of worship, eruvs, and mikvahs in all neighborhoods, lifting previous prohibitions.

Rabbi Avi Schnall, director of Agudath Israel’s New Jersey Office, highlighted the organization’s commitment to facilitating educational facilities for Orthodox children while preserving Jackson’s residential quality of life.

The current settlement reached with a Council none of whose members were part of the body when the lawsuit was initially filed, is a result of the collaborative efforts between Agudath Israel and Jackson’s governing individuals, including Mayor Mike Reina.

Agudath Israel expressed gratitude not only to the council members and Mayor Reina but also to the many residents of Jackson who engaged in the litigation process. Community members’ testimonies, participation in town hall meetings, and correspondence with council members were acknowledged as vital contributions to the resolution.

Rabbi Shlomo Schorr, associate director of Agudath Israel’s New Jersey Office, reflected on the extensive efforts invested over the years and commended the cooperative spirit of the current council members. Looking ahead, Agudath Israel anticipates continued partnership with the Council on future projects to enhance the local community.
