Nassau probation officer indicted for misconduct, falsifying records

September 25, 2024

MINEOLA, N.Y. — A former Nassau County Probation Officer has been indicted on multiple charges for allegedly initiating a sexual relationship with a probationer he supervised, providing her with money and gifts, and falsifying records to conceal the inappropriate relationship, Nassau County District Attorney Anne T. Donnelly announced Tuesday.

Matthew Albertson, 42, of Smithtown, was arraigned before Judge Robert Bogle on nine counts of offering a false instrument for filing, nine counts of falsifying business records, and seven counts of official misconduct. Albertson pleaded not guilty and was released on his own recognizance. He is scheduled to appear in court again on November 6.

According to the DA, Albertson allegedly engaged in a sexual relationship with a female probationer under his supervision between November 2021 and March 2022, violating probation department rules. He reportedly gave the woman money, gifts, and even co-signed a car loan for her.

“Probation Officers are in a position of great trust,” DA Donnelly said in a statement. “This defendant allegedly exploited his power and compromised his sworn duties by pursuing and engaging in an inappropriate sexual relationship with a probationer.”

The investigation, which began in August 2023 after a report from the woman’s attorney, revealed that Albertson falsified case notes on nine occasions between January 2022 and August 2023, claiming to have conducted drug tests and check-ins that did not occur. He also allegedly failed to report the woman’s potential fentanyl overdose and later misrepresented her condition in official records.

If convicted, Albertson faces up to 1-1/3 to four years in prison.
