No Charges in New Jersey Police-Involved Shooting

TRENTON, NJ — The New Jersey state grand jury decided on Monday not to indict two officers involved in the fatal shooting of James Allandale, 61, at a Pine Brook motel on the last day of 2022.

The incident, which occurred on December 31, was the culmination of a warrant operation for attempted murder charges against Allandale. After failed attempts to unlock Allandale’s motel room, Morris County Sheriff’s Emergency Response Team members breached the door. Upon entry, Allandale, armed with a revolver, exchanged gunfire with the officers, resulting in his death.

The Attorney General’s Office of Public Integrity and Accountability conducted a thorough investigation, including reviews of body camera footage and autopsy results. The evidence was presented to the grand jury, which concluded with a “no bill” decision, indicating no charges would be filed against Sgt. Fred Jackson and Sgt. James Krauss.

The officers, who sustained non-life-threatening injuries, were treated at a local hospital. Following the release of the body camera recordings in February, the public was given access to the evidence.

In compliance with state law, the Attorney General’s Office is mandated to investigate any death occurring during police engagement or in custody and present findings to a grand jury. The grand jury is instructed on all potential charges and legal justifications, including self-defense.

The OPIA, following standard operating procedures established in July 2021, ensures impartiality and transparency during such investigations. An administrative review may follow to assess any further actions in accordance with the Attorney General’s Internal Affairs Policy & Procedures.
