JERSEY CITY, NJ – A man imprisoned for a 2003 felony homicide in Jersey City has been released due to a ruling secured by the Attorney General’s Conviction Review Unit (CRU).
Dion Miller, a 54-year-old resident of Jersey City, was serving a 30-year prison sentence following his conviction for felony murder, robbery, and possession of a weapon for an unlawful purpose.
Miller was convicted at a second trial in 2007 of the assault and robbery of a 74-year-old man, Romeo Cavero. On January 5, 2003, Cavero was struck on the head multiple times and robbed of cash outside a Van Nostrand Avenue senior citizens’ building. Cavero’s condition worsened, and he died four days later.
Miller sought a reinvestigation of the case, which the CRU granted following an extensive vetting process. Following a re-investigation and review of new evidence, the CRU determined that Miller should not have been convicted.
On Thursday, a joint motion for a new trial was presented before Superior Court Judge Mitzy Galis-Menendez. Following this, the Attorney General’s Office moved for a dismissal of the indictment with prejudice. A new investigation into the robbery, assault, and murder of Cavero is currently underway.
