Seaside Heights faces another lawsuit over sidewalk fall at borough property

Seaside Heights, NJ – A second personal injury lawsuit has been filed against the Borough of Seaside Heights and associated parties, alleging unsafe sidewalk conditions led to a fall that caused serious injuries.

The complaint, filed in Ocean County Superior Court, centers on an October 13, 2024 incident at 206 Grant Avenue. Plaintiff Constance Lebed, a Manchester resident, claims she was lawfully on the property when she tripped over a raised sidewalk surface.

The lawsuit names multiple defendants, including Anthony Mormile, the Borough of Seaside Heights, and the borough’s Department of Public Works, along with other unidentified parties.

Complaint alleges dangerous condition and negligence

According to the filing, the defendants “owned, operated, maintained and/or controlled the premises in a negligent, careless and reckless manner,” allowing hazardous conditions to exist.

The complaint states the raised sidewalk created a “dangerous and hazardous condition” that caused Lebed to fall and sustain injuries.

It further alleges the condition constituted a “trap, nuisance and hazard,” and that the defendants failed to properly maintain or repair the area.

Plaintiff seeks damages for injuries and losses

Lebed claims the fall resulted in “serious, severe and permanent injuries,” along with medical expenses, lost time from work, and ongoing pain and suffering.

The lawsuit seeks damages, legal costs, and other relief, and includes a demand for a jury trial.
