Former NYC Cop Sentenced for Assaulting Mentally Ill Woman in Holding Cell

BRONX, NY — Bronx District Attorney Darcel D. Clark today announced the sentencing of former NYPD Officer Luis Marte to 60 days in jail for Attempted Assault and Official Misconduct. The conviction stems from an incident in which Marte punched an emotionally disturbed woman in a stationhouse holding cell after she spat on him.

The assault, which occurred on March 1, 2019, in the 44th Precinct, was captured on video surveillance. The footage showed Marte unlocking the cell and repeatedly punching the woman, who was eventually aided by other officers intervening and escorting Marte out of the cell. Fortunately, the woman did not sustain serious injuries.

Bronx Supreme Court Justice Ralph Fabrizio, after a bench trial, found Marte guilty of Attempted Assault in the third degree and Official Misconduct. On January 10, 2024, Marte was sentenced to 60 days in jail and two years probation.
