ORDINANCE OF THE TOWNSHIP OF JACKSON, COUNTY OF OCEAN, STATE OF NEW JERSEY, AUTHORIZING ACQUISITION FOR A PUBLIC RIGHT OF WAY EASEMENT FROM THE JACKSON TOWNSHIP BOARD OF EDUCATION FROM “LONDON DRIVE” PURSUANT TO N.J.S.A. 40A:12-4(A)
BE IT ORDAINED by the Township Council of the Township of Jackson, County of Ocean, State of New Jersey, as follows:
SECTION 1. Pursuant to N.J.S.A. 40A:12-4(a) the Township of Jackson is authorized to acquire any interest in real estate within the municipality; and
WHEREAS, the Jackson Township Board of Education is currently the owner of certain real property known as Block 13001, Lot 49 and the Jackson Township Board of Education and has previously granted a 40 foot wide access and utility easement to the Jackson Municipal Utilities Authority, the owner of Lot 24 in Block 13001; and
WHEREAS, the 40-foot-wide access and utility easement exists upon Lot 49 in favor of the Jackson Municipal Utilities Authority while a 50-foot-wide access and utility easement in favor of the Jackson Township Board of Education exists upon Lot 24 owned by the Jackson Township Municipal Utilities Authority; and
WHEREAS, in its entirety, the existing private access driveway/roadway within the referenced easements provide a connection from Georgian Avenue, a 75-foot-wide improved Township right of way at the westerly end, to London Drive, a 55-foot-wide improved Township right of way at the eastern end. It is the intention of this Ordinance to authorize the Township to acquire these two (2) easement areas in order to establish the public right of way to be known as London Drive, establish a one-way direction with respect to same and permit limited vehicular traffic restricted to vehicles of the Jackson Township Municipal Utilities Authority and Class 4 school buses only.
SECTION 2. The Township is hereby authorized to acquire a 40-foot-wide portion of Block 13001, Lot 49 from the Jackson Township Board of Education and a 50-foot-wide area of Lot 24 owned by the Jackson Township Municipal Utilities Authority for the purposes of establishing a public right of way Easement pursuant to N.J.S.A. 40A:12-4(a). This right of way shall be accomplished pursuant to an easement from the Jackson Township Board of Education in accordance with the attached Exhibit A and the Jackson Township Municipal Utilities Authority in accordance with the attached Exhibit B.
SECTION 3. This Ordinance shall authorize acceptance of a right of way easement in accordance with the attached Exhibits from the Board of Education and the Jackson Township Municipal Utilities Authority.
SECTION 4. If any section, subsection, sentence, clause, phrase or portion of this ordinance is for any reason held to be invalid or unconstitutional by a court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision, and such holding shall not affect the validity of the remaining portions hereof.
SECTION 5. This Ordinance shall take effect after second reading and upon publication, as required by and in conformance with law.

NOTICE
NOTICE IS HEREBY GIVEN that the foregoing ordinance was introduced and passed by the Township Council on first reading at a meeting of the Township Council of the Township of Jackson held on the 27th day of May, 2025, and will be considered for second reading and final passage at a regular meeting of the Township Council to be held on the 12th day of June, 2025, at 6:30 p.m., at the Township Municipal Building, located at 95 West Veterans Highway, Jackson, New Jersey, at which time and place any persons desiring to be heard upon the same will be given the opportunity to be so heard.
