NEW YORK, NY — A man serving life in prison for the kidnapping and murder of a federal informant in the Bronx has lost his bid to overturn his conviction, with a federal judge rejecting his post-conviction challenge.
Juan Rivera, convicted in 2018 for his role in the killing of Robert Bishun, sought to vacate his sentence under federal law. But in a detailed opinion, U.S. District Judge Arun Subramanian denied the motion, finding his claims either already rejected on appeal or lacking legal merit.
Violent Crime at Center of Case
Rivera was convicted alongside co-defendant Robert Pizarro in connection with the 2016 kidnapping and killing of Bishun, a former heroin dealer turned federal informant.
Prosecutors said the pair bound Bishun with zip ties during a robbery attempt at his auto body shop, forced him into a vehicle, and later strangled him. His body was discovered in the Bronx with a zip tie around his neck.
A jury found Rivera guilty on multiple counts, including kidnapping resulting in death and witness tampering murder. He was sentenced in 2019 to life in prison, along with additional decades-long terms on related charges.
Appeals and Claims Rejected Again
Rivera challenged his conviction on appeal, arguing prosecutors failed to timely disclose exculpatory evidence. The Second Circuit rejected that claim in 2023, finding no prejudice to his defense.
In his latest filing, Rivera raised similar arguments under a § 2255 motion, which allows federal prisoners to challenge their sentences. He also claimed ineffective assistance of counsel and other legal errors.
Judge Subramanian ruled those arguments either could not be relitigated or failed to meet the high bar required to overturn a conviction.
Court Declines to Appoint Lawyer
Rivera also requested a court-appointed attorney for his post-conviction case. The judge denied that request, finding the claims did not warrant additional legal assistance.
