New Jersey Bill S3481 to Mandate Disclosure of Construction Project Financing
TRENTON, NJ – In an effort to increase transparency in government contracting, a new bill proposed in the New Jersey Senate could radically alter the way public contracts work in the Garden State.
Introduced on June 20, 2024, by Senator Andrew Zwicker of District 16, which includes Hunterdon, Mercer, Middlesex, and Somerset, New Jersey Senate Bill 3481 seeks to enhance transparency in construction projects. This legislative proposal requires applicants of construction projects to provide detailed disclosures regarding their project financing.
Under the proposed legislation, all applications for construction permits must include a general description of the proposed work, its location, the use and occupancy of all parts of the building or structure, along with a detailed disclosure of the anticipated amounts and sources of funding. The enforcement of this requirement will be ensured through the necessity of a certification that the funding information provided is accurate or an update of the funding details before a certificate of occupancy can be issued.
This bill supplements the existing “State Uniform Construction Code Act,” aiming to provide greater clarity and accountability in the financing of construction projects. The Commissioner of Community Affairs is tasked with adopting specific rules and regulations within 180 days of the enactment to support the identification and disclosure requirements laid out in the bill.
Senate Bill 3481 is set to take effect on the first day of the ninth month following its enactment, signaling a significant shift towards greater transparency in construction project financing within the state.
