ORDINANCE NO. 2025 –11
AN ORDINANCE OF THE TOWNSHIP OF JACKSON, COUNTY OF OCEAN,
STATE OF NEW JERSEY, AMENDING AND SUPPLEMENTING CHAPTER 3
OF THE TOWNSHIP CODE OF THE TOWNSHIP OF JACKSON, ENTITLED
“ADMINISTRATION OF GOVERNMENT”
BE IT ORDAINED by the Mayor and Township Council of the Township of
Jackson, County of Ocean, and State of New Jersey, as follows:
SECTION 1. Chapter 3 of the Township Code of the Township of Jackson,
entitled “Administration of Government,” Article V, entitled “Administrative
Organization,” § 3-38, entitled “General plan,” subsection A, entitled
“Departments” is hereby amended and supplemented so as delete subsection
(6) in its entirety, and replace it with the word “Reserved.”
SECTION 2. Chapter 3 of the Township Code of the Township of
Jackson, entitled “Administration of Government,” is hereby amended and
supplemented so as delete § § 3-75, 3-76, 3-77, 3-78 and 3-79 in their
entirety.
SECTION 3. Chapter 3 of the Township Code of the Township of
Jackson, entitled “Administration of Government,” is hereby amended and
supplemented so as amend Article X, entitled “Department of Public Works,”
so as to create § 3-131, entitled “Division of Recreation and Senior Services,”
which shall read in its entirety as follows:
§ 3-131. Division of Recreation and Senior Services
The Division of Recreation and Senior Services shall:
A. Administer the work of the Division, and administer and operate
playgrounds, facilities for indoor and outdoor sports, athletic, cultural and
recreational programs and activities for children, youth and adults of the
Township, including celebration of events, holiday activities and summer
camps; and where authorized by law and by ordinance of the Township
Council, charge and collect on behalf of the Township a reasonable fee for
each person for admission to or use of facilities, programs and activities
provided for under this provision. B. Use public school property by agreement with the Board of Education. C. Plan and develop additional public recreational areas and facilities. D. Cooperate with other municipal departments, service clubs and
organizations in furthering recreational and cultural interests in the
Township. E. Adopt reasonable rules, regulations and bylaws, subject to approval of
the Council, for the conduct of persons participating in programs and
activities or utilizing recreation facilities or equipment sponsored by the
Division. F. Study, investigate, develop and recommend recreation programs in
conjunction with the Recreation Committee. G. Conduct studies of the present and future recreational needs of the
Township and develop immediate and long-range plans in consultation
with the Recreation Committee for recommendation to the Mayor and the
Township Council. H. Maintain such records as may be required to control Division receipts,
property and personnel, and provide information to the Mayor for
budgeting and financing of recreational programs. Such records shall
include time cards, or the equivalent Township approved time-tracking
device, for part-time and seasonal personnel. I. Be responsible to the Township Council for the proper custody and
preservation of the books, records and property under the Division’s
control, and the faithful performance of the duties of the Division. J. Submit to the Mayor and Business Administrator monthly reports
concerning the conduct and progress of the Division, including receipts
and monies. K. Administer the expenditure of funds in accordance with the annual
budget. L. Hire part-time and seasonal staff as needed, with the approval of the
Mayor, to carry out the functions of the Division.
SECTION 4. Chapter 3 of the Township Code of the Township of
Jackson, entitled “Administration of Government,” is hereby amended and
supplemented so as amend Article X, entitled “Department of Public Works,”
so as to create § 3-132, entitled “Recreation Advisory Board,” which shall
read in its entirety as follows:
§3-132. Recreation Advisory Board
A. Organization. There is hereby established within the Division of Recreation
and Senior Services a Recreation Advisory Board which shall consist of a
number of representatives from various recreational organizations located
within the Township as set forth below. B. Membership. The Recreation Advisory Board shall consist of one
representative, appointed by the Mayor, with the advice and consent
of the Township Council, from each organization substantially utilizing
Township facilities. Those organizations shall include, but are not limited
to, Jackson Holbrook Little League, Jackson Soccer, Jackson Lacrosse,
Jackson Roller Hockey, American Youth Football and Recreation Softball. C. Term. All members of the Recreation Advisory Board shall serve for
the balance of the calendar year in the year of their initial appointment.
Thereafter, all appointments to the Board shall be for a term of one year,
expiring on December 31 of the year of appointment. All members
shall be appointed by resolution. The Council liaisons to the Recreation
Committee shall also serve as members of the Recreation Advisory
Board. D. Alternate members. The Mayor with the advice and consent of the
Township Council may, by resolution, appoint one alternate member from
each organization represented in the Recreation Advisory Board. Alternate
members shall take the place of a member from the same organization
unable to attend a meeting. The length of the terms of the alternate
members shall be the same as the length of the terms of the regular
members of the Board. E. Compensation. The members of the Board shall serve without
compensation. F. Meetings; designation of Chairperson. The Recreation Advisory Board
shall meet no less than twice per year to carry out the functions stated
in Subsection G of this section. At the first meeting of the year, the
members of the Board shall hold an election to designate a Chairperson.
The Chairperson shall preside over all meetings, be responsible for
establishing the meeting agenda and act as the liaison between the
Board and the Township Council and Assistant Recreation Supervisor.
The agenda shall, at a minimum, provide each organization represented
in the Board the opportunity to discuss their condition, needs, goals and
objectives. If additional meetings during any given year are needed, a date
and time shall be agreed upon by a majority vote at least 30 days prior to
the additional meeting. At the conclusion of the meeting, the Board may
engage in an open discussion as needed. G. Functions and duties. The Board is purely advisory in nature. All decisions
with respect to recreation programs and projects are the responsibility of
the governing body. The Recreation Advisory Board shall:
(1) Formulate recommendations to the Mayor and Township Council
concerning the development of recreation programs for residents
of all ages;
(2) Act in an advisory capacity to the Mayor and Township Council in
all matters pertaining to the recreation programs and the utilization
of recreational areas, including, but not limited to, the scheduling,
maintenance and utilization of such recreation areas and the need
for equipment, services and building space for recreation;
(3) Make such individual studies and reports as may be requested by
the Mayor, Township Council or Assistant Recreation Supervisor;
(4) Refer all maintenance concerns to the Assistant Recreation
Supervisor; and
(5) Recommend fees for participation in Township-organized recreation
activities and leagues. H. Vacancies. A vacancy occurring other than by expiration of a term shall
be filled for the unexpired term only, and the new appointee shall be
appointed from amongst the members of the organization which the prior
appointee had represented on the Board.
SECTION 5. Chapter 3 of the Township Code of the Township of
Jackson, entitled “Administration of Government,” is hereby amended and
supplemented so as amend Article X, entitled “Department of Public Works,”
so as to create § 3-133, entitled “Recreation/Special Events Coordinator”
which shall read in its entirety as follows:
§3-133. Recreation/Special Events Coordinator
A. There may be a Recreation/Special Events Coordinator who shall assist
Administration in the administration and operation of the programs and
activities of the Division. The Recreation/Special Events Coordinator
shall be appointed by the Business Administrator, with the approval of
the Mayor. The Recreation/Special Events Coordinator shall possess a
bachelor’s degree in recreation, or a closely related field, and have three
years of experience in managing and operating recreational programs
and activities. Additional experience may be substituted for the education
requirement on a year-for-year basis, with 30-semester-hour credits
being equal to one year of experience. B. The Recreation/Special Events Coordinator shall carry out such duties as
specifically designated by Administration.
SECTION 6. Chapter 3 of the Township Code of the Township of
Jackson, entitled “Administration of Government,” is hereby amended and
supplemented so as amend Article X, entitled “Department of Public Works,”
so as to create § 3-134, entitled “Senior Services Program; Recreation
Program Adminsitrator,” which shall read in its entirety as follows:
§3-134. Senior Services Program; Recreation Program Administrator
There is hereby created within the Division of Recreation and Senior Services,
the Senior Services Program, the head of which shall be the Recreation
Program Administrator. The Recreation Program Administrator shall be
appointed on the basis of education, background and experience in the field
of senior citizen program administration, which shall include graduation from
a four-year course at an accredited college or university, and three years’
experience in planning, developing and supervising recreational programs
designed especially for the elderly. The Recreation Program Administrator
shall coordinate and develop senior citizens programs and activities in the
Township.
SECTION 7. Chapter 3 of the Township Code of the Township of
Jackson, entitled “Administration of Government,” is hereby amended and
supplemented so as amend Article X, entitled “Department of Public Works,”
so as to create § 3-135, entitled “Powers and duties of the Senior Services
Program,” which shall read in its entirety as follows:
§3-135. Powers and duties of the Senior Services Program.
Under the direction and supervision of the Recreation Program Administrator,
the Senior Services Program shall:
A. Develop programs and coordinate projects directed to the development of
needed senior services in the Township. B. Act as liaison between the Mayor and Township Council and various
senior service agencies and programs, both public and private, on the
local, state and federal levels. C. Actively seek out and advise of grants, funds and loans which may be
available for senior services and related programs. D. Develop an understanding of the problems of senior citizens. E. Establish a central location where senior citizens facing the problems
of aging can turn for assistance through information on community
resources. F. Identify, locate and expand available community resources for senior
citizens and the make efforts to cause such resources to be more readily
accessible and available to those who need them. G. Act as a liaison between individual senior citizens, senior citizen groups
and community resources and facilities and assistance to senior citizens. H. Refer to the appropriate municipal officials any problems of individual
senior citizens or groups of senior citizens relating to the functioning of
municipal government, its agencies and instrumentalities. I. Distribute information on resources available to senior citizens. J. Render assistance to senior citizens in dealing with the problems of
aging, including assistance programs for senior citizens, recreation,
social and entertainment programs available for senior citizens.
SECTION 8. All ordinances or parts of ordinances inconsistent herewith
are hereby repealed.
SECTION 9. If any section, subsection, sentence, clause, phrase or portion
of this ordinance is for any reason held to be invalid or unconstitutional by
a court of competent jurisdiction, such portion shall be deemed a separate,
distinct and independent provision, and such holding shall not affect the
validity of the remaining portions hereof.
SECTION 10. This ordinance shall take effect after second reading and
publication as required by law.
NOTICE
NOTICE IS HEREBY GIVEN that the foregoing ordinance was introduced and
passed on first reading at a regular meeting of the Township Council of the
Township of Jackson, in the County of Ocean, State of New Jersey, held on
April 22, 2025, and will be considered for second reading and final passage
at the regular meeting of said Governing Body to be held on the 13th day of
May, 2025, at 6:30 p.m., or as soon thereafter as this matter can be reached,
at the meeting room of the Municipal Building located at 95 W. Veterans
Highway, Jackson, New Jersey, at which time all persons interested shall be
given an opportunity to be heard concerning this ordinance.
