Queens, NY – Queens District Attorney Melinda Katz today announced the sentencing of Rodolfo Montero, 29, to an 18-year prison term following his guilty plea to attempted murder in the second degree. Montero’s sentencing stems from a 2020 incident where he discharged an assault rifle at NYPD officers responding to a domestic violence call at his College Point residence.
The violent episode unfolded on September 13, 2020, after Montero assaulted his 28-year-old girlfriend in the presence of their 1-year-old child. The situation escalated when Montero, armed with an assault rifle, threatened to kill his girlfriend. She, along with Montero’s mother and the child, escaped the home and sought police assistance.
Upon the officers’ arrival around 4:30 p.m., Montero fired multiple rounds from his home, striking a vehicle parked nearby, though, thankfully, no officers were injured. After firing additional shots from a different vantage point within the house, Montero eventually exited the home and surrendered to the authorities. Police recovered the assault rifle and other ballistic evidence from the scene.
