NEW YORK, NY – The U.S. Attorney for the Southern District of New York, Damian Williams, along with Rear Admiral John Mauger of the First Coast Guard District, announced the arrests of Richard Cruz and Jaime Pinilla Gomez. The two men face charges stemming from a tragic incident on July 12, 2022, when the vessel they were operating capsized in the Hudson River, leading to the deaths of a seven-year-old boy and a 48-year-old woman.
Cruz, 32, and Gomez, 25, both from Elizabeth, New Jersey, were apprehended today and are set to appear before U.S. Magistrate Judge Ona T. Wang. The arrests highlight the grave consequences of disregarding federal regulations and safety protocols for commercial vessels. The defendants are accused of operating the motor vessel Stimulus Money under hazardous conditions, including exceeding the vessel’s capacity and navigating at high speeds during adverse weather, without the necessary U.S. Coast Guard certifications.

This fatal event underscores the importance of adherence to maritime safety standards and the role of law enforcement in ensuring the security of passengers. The Coast Guard and the U.S. Attorney’s Office have reaffirmed their dedication to preventing similar tragedies by prosecuting those responsible for illegal passenger operations.
Cruz and Gomez are charged with misconduct and neglect of a ship officer resulting in death, facing up to 10 years in prison if convicted. This case serves as a reminder of the deadly risks associated with illegal charter operations and the collective effort required to detect and deter such activities.
