Jury Convicts Newburgh Man in Middletown Assault Case

ORANGE COUNTY, NY – Orange County District Attorney David M. Hoovler announced the conviction of Brian Powell, 50, of Newburgh, in a recent jury trial. Powell was found guilty of Assault in the Third Degree and Unlawful Imprisonment in the Second Degree in Middletown City Court. He is facing up to a year in Orange County Jail for each count and will be sentenced on January 26, 2024. Following the verdict, Powell was remanded without bail.

The trial revealed that on January 7, 2023, a female victim was assaulted in a Middletown apartment by Powell after an acquaintance left her there. Powell made unwanted advances and when the victim tried to leave, he punched her repeatedly in the face, causing significant injury. The victim, in an attempt to escape, considered jumping from a second-story window but was stopped by Powell. She was able to defend herself by stabbing Powell, allowing her to halt the assault. The police were called to the scene and provided medical attention to both Powell and the victim.
