NEW YORK – Jose Barcia, 52, of Flushing, Queens, has been indicted on criminal charges for a fatal collision that occurred on March 13 in East Elmhurst. According to the District Attorney, Barcia is accused of speeding through a crosswalk, making a left turn, which resulted in the death of an 8-year-old boy and injuries to his 10-year-old brother.
Barcia faces charges of criminally negligent homicide, failing to yield to traffic, disobeying speed restrictions, and other related offenses. The grand jury indictment was filed on April 18, and Barcia is set to be arraigned on May 2.
The incident was investigated by the NYPD Highway District’s Collision Investigation Squad and the Queens District Attorney’s Vehicular Homicide Unit. Assistant District Attorney Brian Cox will prosecute the case under the supervision of various officials from the District Attorney’s office.
