Trenton man convicted in 2022 shooting faces up to 30 years

TRENTON, N.J. — A Mercer County jury has found a Trenton man guilty of aggravated assault and multiple weapons charges in connection with a 2022 shooting, prosecutors announced.

Davion S. Smith, 26, was convicted on Tuesday on all counts of the indictment, including unlawful possession of a handgun, possession of a firearm for an unlawful purpose, aggravated assault, and certain persons not to possess a firearm.

Authorities said the charges stemmed from an August 13, 2022, shooting on the 100 block of Oakland Avenue. Around 1:30 a.m., Trenton police responded to reports of gunfire and saw a vehicle, driven by Smith, fleeing the scene at high speed. A subsequent search of the vehicle uncovered a defaced .38 caliber revolver, and surveillance footage showed Smith firing a handgun at another vehicle before fleeing.

The trial, which lasted two weeks, was prosecuted by Mercer County Assistant Prosecutors Michael J. Mennuti and Jeffrey C. McElwee Jr. before Mercer County Superior Court Judge Darlene J. Pereksta. The case was investigated by the Mercer County Shooting Response Team and Detective Sarai Cheek of the Trenton Police Department. Smith was represented by defense attorney Andrew Seewald.

Smith is scheduled for sentencing on April 4 and faces up to 30 years in prison after the jury deemed him eligible for an extended sentence under New Jersey’s “Persistent Offender” statute.
