Judicial Order Ensures Restoration of Contaminated Waterfront Land in Palmyra

PALMYRA, NJ – A Judicial Consent Order on August 15, 2022, between the Department of Environmental Protection (DEP) and Fillit, along with Sansone Urban Renewal Entity II, LLC, has led to a series of actions to remediate and protect 31.34 acres of waterfront land along Pennsauken Creek and Palmyra Cove.

The agreement addresses past violations where the property had been used to illegally stockpile mulch, treated wood, concrete, and contaminated soil.

As part of the settlement, a conservation easement will be established to protect the land, which also includes wetlands along the banks of the Delaware River. In addition, Fillit has been ordered to remove all solid waste, close a historic municipal landfill located on the property, and implement green infrastructure best management practices for stormwater management

.Fillit has paid a civil penalty of $450,000, in addition to an outstanding penalty of $12,000 from 2011. Separately, the DEP secured a judgment of $3,550,000 against former site operators, Jersey Recycling Services, LLC, and its owner, Bradley Sirken, who had been previously investigated in 2017 for connections to organized crime in New Jersey’s solid waste industry.
