New York’s highest court has overturned Harvey Weinstein’s conviction of rape in 2020 due to what it calls “egregious errors” made during the trial.

The New York Court of Appeals deemed that the trial court wrongly allowed testimony relating to uncharged prior sexual acts, leading to a situation where the errors were considered irreparable without a new trial. This decision comes after Weinstein was sentenced to 23 years for sexually assaulting Jessica Mann and Mimi Haleyi based on what is now considered prejudicial testimony.

In a 4-3 ruling issued on a Thursday, the New York Court of Appeals criticized the trial court for permitting testimony about uncharged prior sexual acts against Weinstein. The majority opinion stated that these errors tainted the trial and could only be rectified through a new trial.

The appeal highlighted concerns that the prejudicial nature of the evidence presented had a significant impact on the sentence Weinstein received.

While the majority on the New York Court of Appeals found in favor of overturning Weinstein’s conviction, dissenting voices accused the majority of regressing from advancements in understanding sex crimes and victim responses. The dissenting opinion argued that the decision to overturn the conviction could potentially jeopardize progress in comprehending the complexities of such cases.
