A 46-year-old Boone man has been arrested and charged with felony murder following a fatal assault that occurred late Sunday night in Watauga County, authorities confirmed Monday.

Deputies with the Watauga County Sheriff’s Office, along with Boone Police, medics, and fire and rescue personnel, responded to a report of an unresponsive male near Health Center Drive and White Laurel Lane at approximately 11:40 p.m. on Sunday. The caller reported the man was not breathing, and CPR was already underway by a bystander.

First responders arrived at the scene and determined the incident was the result of an assault. Despite life-saving efforts by emergency personnel, the victim was pronounced dead at the scene. He was later identified as Darian Lee Edwards, 40, of Hickory, North Carolina.

Following a rapid investigation, authorities arrested Christopher Phillip Ervin, 46, of Boone, charging him with felony murder. He is currently being held at the Watauga County Detention Center under a $1 million bond.

Sheriff Len Hagaman commended law enforcement and emergency crews for their response and the quick resolution of the case. “This swift arrest is the result of our office’s commitment to seeking justice for the victim and ensuring the safety of our community,” he said.

Investigation into motive and circumstances continues

Investigators have not disclosed details about the circumstances leading up to the assault or any possible motive. Authorities said the investigation remains active, and additional charges could be considered depending on the outcome of forensic and witness evidence reviews.

The sheriff’s office is asking anyone with information related to the incident to contact their tip line. No additional suspects are being sought at this time, and officials believe there is no ongoing threat to the public.

Watauga County officials have not announced funeral arrangements for Edwards, and his family has not issued a public statement.

Ervin is expected to appear in court for a preliminary hearing in the coming days. Legal counsel has not yet been identified on his behalf.
