GOP States Request Federal Judge End DACA

Nine Republican states asked a federal judge in Texas to end the Deferred Action for Childhood Arrivals (DACA) program, according to a Tuesday night court filing.

Texas, Alabama, Arkansas, Louisiana, Nebraska, South Carolina, West Virginia, Kansas and Mississippi are asking the judge to force the U.S. government to not approve new DACA applications and to end the existing program in two years, according to the court filing. The program currently applies to nearly 600,000 migrants who arrived in the U.S. as children, according to U.S. Citizenship and Immigration Services (USCIS).

“The final rule — as the latest manifestation of the DACA program  — is substantively unlawful for the same reasons as the DACA Memorandum,” the Republican states argued. “The court should declare it unlawful and unconstitutional, vacate it in its entirety, and permanently enjoin its implementation (with a prudent transition for existing DACA recipients).”

A federal judge ruled in July 2021 that the program was illegal. The Biden administration tried to codify the Obama-era program in August.

The Fifth Circuit Court of Appeals ruled that the fate of the must be handed down to a lower court.

President Joe Biden has advocated to give DACA recipients a pathway to citizenship.

“It is not only the right thing to do, it is also the smart thing to do for our economy and our communities,” Biden said in a statement while urging Congress to take action in August.
