New Jersey Proposes Alternatives to Detention for Juvenile Gun Crimes

TRENTON, NJ—New legislation in New Jersey seeks to reform the treatment of juveniles charged with firearms offenses by introducing alternatives to detention. The bill proposes using residential and non-residential reengagement centers as potential juvenile placements instead of traditional detention facilities.

Under current state law, judges and court intake officers are encouraged to consider alternatives to detention for juveniles charged with certain crimes. This bill expands those alternatives to include placement in re-engagement centers for those charged with unlawful possession of a weapon or a prohibited device.

Additionally, it mandates the involvement of a parent, guardian, or appointed court official, who must attend hearings and provide written assurance of compliance with court appearances.

The bill also allows courts to order placement in re-engagement centers for juveniles adjudicated delinquent for similar offenses. The centers are defined as facilities offering comprehensive rehabilitation services, including counseling, career services, educational support, and community reintegration programs.

The bill specifies that parents or guardians must participate in the restitution process, enhancing their involvement in the juvenile’s rehabilitation journey.

This initiative represents a shift towards more rehabilitative and community-focused responses to juvenile delinquency in New Jersey.
